These Terms are a contract between you and Copper Hare. Please read them. If you do not agree, do not use the site.

These Terms of Use (“Terms”) govern your access to and use of the website at copper-hare.com and any related services (the “Site”) provided by Copper Hare LLC (“Copper Hare,” “we,” “us”). By using the Site you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site you represent that you meet these requirements.

Copper Hare provides search and staffing services for the data center construction trades. The Site provides information about those services and ways to contact us. Nothing on the Site is a guarantee of employment, placement, a candidate, a particular outcome, rate, or schedule. Any engagement for staffing or placement services is governed by a separate written agreement.

3. No employment relationship created by the Site

Using the Site or submitting your information does not create an employment, agency, or partnership relationship between you and Copper Hare, and is not an offer of employment by Copper Hare or any client.

You are responsible for the accuracy of information you submit. You grant Copper Hare a non-exclusive, royalty-free license to use the information you provide for the purpose of delivering our services (including presenting you to clients), consistent with our Privacy Policy. Do not submit confidential information you are not authorized to share.

6. Intellectual property

The Site, including its text, design, graphics, logos, and the Copper Hare name and marks, is owned by Copper Hare or its licensors and protected by intellectual-property laws. You may view and use the Site for its intended purpose; you may not copy, modify, distribute, or create derivative works without our written permission.

By contacting us or providing your phone number, you agree we may communicate with you about your inquiry. Marketing calls or texts are sent only with your consent and are never a condition of any service. See our SMS / Texting Terms and Privacy Policy.

8. Third-party links

The Site may link to third-party sites or resources. We do not control and are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on it is complete or current.

TO THE FULLEST EXTENT PERMITTED BY LAW, COPPER HARE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold Copper Hare harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Subject to the arbitration agreement below, the state and federal courts located in Laramie County, Wyoming will have exclusive jurisdiction, and you consent to venue there.

Arbitration; class-action waiver

Please read this carefully — it affects how disputes are resolved. Except for the excluded claims described below, any dispute arising out of or relating to the Site or these Terms will be resolved by final and binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court. You and Copper Hare each waive any right to a jury trial and to bring or participate in a class, collective, consolidated, or representative action. The arbitration will take place in Laramie County, Wyoming, or by videoconference, and the arbitrator may award only the individual relief a court could.

Excluded claims. This section does not apply to any claim that cannot be arbitrated or waived as a matter of law — including, where applicable, claims of sexual assault or sexual harassment under the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act — and either party may bring an individual claim in small-claims court.

30-day opt-out. You may opt out of this arbitration agreement by emailing hello@copper-hare.com with your name and a statement that you opt out, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms. If any portion of this section is found unenforceable, the remainder will continue to apply, except that the class-action waiver is not severable from the rest of this section.

13. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted with a new “Last updated” date. Your continued use of the Site means you accept the updated Terms.
